DIVORCES AND SEPARATIONS
When the couple is facing a breakup, many doubts arise, such as: Can I divorce or separate if my partner does not want to? Who do the children live with? What visitation rights do I have? What alimony should be established for my children? These and other questions that arise need the advice of professionals specialized in Family Law. REGULATORY AGREEMENTS AND SHARED CUSTODY
The regulatory agreement is a document in which the persons involved in a separation or divorce process agree on the personal and economic consequences of their breakup. This agreement must be made by mutual agreement and becomes binding after the separation or divorce takes place. Given its obligatory nature, the content of the regulatory agreement is of great importance. It establishes rights and obligations relevant to the long term, so it is advisable to have the advice of a lawyer specialized in Family Law. This agreement must be approved by a Judge or Notary (in the case of an express divorce processed before a notary) in order to be valid. The objective of this control is to protect the rights of both parties and, in the case of minor children, to ensure that their interests and rights are safeguarded above the interests of the parents.
Joint custody is a form of child care and parenting used in cases of separation or divorce in Spain. In this type of custody, both parents share the responsibility of raising and caring for their children equally. Shared custody is the preferred formula in Spain, although single-parent custody is still used when necessary. There are various forms of joint custody, such as living together under the same roof or in different homes and allowing the child to move between them. We request the same for our clients in case this is the desired formula.
